Isu-Isu Berkaitan Perundangan Perbankan Islam di Malaysia

Bismillah walhamdulillah. Sistem perbankan Islam di Malaysia merupakan antara sistem perbankan Islam yang terawal wujud di bumi yang fana ini. Bermula pada tahun 1983 dengan berpaksikan Akta Perbakan Islam 1983, sistem perbankan Islam di Malaysia kini mengorak langkah dengan lebih jauh demi kelangsungan kepentingan ummah dan demi konsep Rahmatan Lil'alamin. Atas dasar itu pada tahun 2013 melalui BNM telah diperkenalkan IFSA 2013 bagi memastikan Perbankan Islam sentiasa relevan di hati masyarakat dan selaras dengan objektif kewujudan perbankan Islam itu sendiri. Sungguhpun demikian, pada hakikatnya hari ini beberapa perkara perlu dilihat dengan lebih terperinci agar permasalahan ini tidak memberi gambaran yang negatif terhadap perbankan Islam iaitu:

a. Islamic banks Insufficient Legal Protection
b.  Jurisdiction– Civil or Shariah Court
c. Disparity in Concepts and Practice
d. Ownership of Underlying Assets
e.  Lender of Last resort
f. Amendmen of existing laws

Sehubungan itu sesuatu perlu dilakukan agar perkara-perkara di atas dapat diatasi seterusnya dapat membantu perbankan Islam memonopoli industri perbankan di Malaysia.

  1. In my opinion, regarding the jurisdiction, we should put a special concern to the law relating legal procedures and courts to suit the requirement of Islamic banks. The issues are the dilemma between the civil and shariah court. In one hand, shariah courts are not having adequate capability to settle the islamic banking issues as the disputes over Islamic banking issues are not only related to islamic law, but also related to some other laws which are out of the authorization of shariah courts and as the consumers of Islamic banks are not limited to muslims but some of non-muslims are using those products. Besides that, the issue also arise from the limit power of shariah court imposing the fines which may not be suitable to the Islamic banking disputes.

    And in other hand, the limitation of civil courts is also another issue to be highlighted. Not all the civil court judges are trained with the islamic law, and in this case islamic banking issues that make it difficult to judges to decide and up to this time, judges are in need of Shariah advisers' assistance in hearing the disputes in the court.

    Therefore, we still require some actions to improve the capability of the judges (currently the civil judges) to settle the disputes in Islamic banking, or instead of that, the settlement through arbitration, sulh or consultation are also the options.

    1. yes. dilemma between the civil and shariah-this is a Jurisdiction between shariah court or civil court.
      How about Disparity in Concepts and Practice- for instance Qard al hassan contract in Islamic banking Practice?
      How about Amendmen of existing laws-for instance Islamic Financial Services Act 2013?

  2. In my perspective, society today is more open to accept Islamic banking after the banking act has been introduced. Maybe they already have the awareness and are also able to know the real function of Islamic banking as every piece of information is available at their fingertips only now. Thank you, Dr Faisol.
